FEDEX ULTIMATE FAN CONTEST OFFICIAL RULES

(the “Official Rules”)

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THE FEDEX ULTIMATE FAN CONTEST IS SPONSORED BY FEDEX CORPORATE SERVICES, INC. (“Sponsor” or “FedEx”).

THE ULTIMATE FAN CONTEST CONSISTS OF FIVE (5) DISTINCT CONTESTS (EACH A “CONTEST”) AS DESCRIBED BELOW, AND ELIGIBLE PARTICIPANTS MAY SUBMIT ENTRIES FOR ANY OR ALL OF THE CONTESTS IN THE MANNER PROVIDED IN THESE OFFICIAL RULES, WHICH GOVERN THE CONTESTS AND MAY BE CHANGED OR AMENDED BY SPONSOR AT ANY TIME IN IT IS SOLE DISCRETION. SPONSOR MAY CEASE OFFERING THE CONTEST(S) AT ANY TIME WITHOUT RECOURSE.

Contest Summary:

The FedEx Ultimate Fan Contest consists of 5 individual Contests. Each Contest consists of 8 stages to select a winner. Each Contest requires the use of writing skills, video creation and social media posting. Entrants that advance to the video stage will be provided a unique URL for Entrant to share on their own social media handle for their followers to access a link to reach the voting page. In addition, winners may be required to post FedEx provided content. Each Contest provides for one (1) winner.

The FedEx Ultimate Fan Contest and each of the (5) individual contests are sponsored by FedEx. The National Association of Stock Car Auto Racing (NASCAR), Joe Gibbs Racing, Union of European Football Associations (UEFA), the PGA TOUR (PGA TOUR, Inc.), the National Basketball Association (NBA), the Memphis Grizzlies, and the National Football League (NFL) are not sponsors of, do not administrate, and are not responsible or liable in any way for the Official Rules, entry, voting, entrants, finalists, winners, or prizing.

The National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC, NFL Productions, LLC, NFL International, LLC, NFL Players Association, NFL Players Incorporated, and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, members, representatives, and employees (collectively, the “NFL Entities”) will have no liability or responsibility for any claim arising in connection with participation in this Sweepstakes or any prize awarded. The NFL Entities have not offered or sponsored this Sweepstakes in any way.

1. CONTEST PERIOD:

Each Contest consists of 8 stages and the stages and stage dates are set out below under each Contest title. All stage dates and stage requirements are subject to change at the sole discretion of FedEx. All contest dates and times use the Eastern Time (ET) zone.

2. ELIGIBILITY:

The minimum qualifications for eligibility in each Contest include whether a person:

  1. Is an individual person and legal resident of one of the fifty (50) United States or the District of Columbia at the time of entry;
  2. Is at least eighteen (18) years of age at the time of entry;

In addition, if an Entrant is selected as a potential winner of the Contest(s), they will be required to consent to and pass a background and reputational check conducted by or on behalf of, and which is acceptable to, FedEx, and maintain the acceptable status throughout participation in the Contest(s), which includes using the prizes awarded in the Contest(s).

Sponsor shall determine, in its sole discretion, whether a person who submits an entry to a Contest meets the eligibility criteria to participate in the Contest(s). Sponsor’s decisions regarding eligibility and all other aspects of a Contest(s) are final and binding. Each person submitting an entry(ies) confirms and agrees that by submitting such entry(ies) they meet the criteria described above, and that Sponsor’s decisions regarding their eligibility are nevertheless(s) final and binding. Persons determined to be eligible by Sponsor are hereinafter referred to as “Entrants”, ”you” or “your”.

Sponsor, its parent and affiliated companies, and each of their respective, officers, directors, employees, and agents, and their immediate family members (i.e., parent, child, sibling, and spouse) and/or persons living in the same household of such individuals (whether related or not) are not eligible to participate in any Contest. Each Contest is subject to all applicable federal, state, and local laws and regulations, and is void if prohibited by law.

3. HOW TO ENTER:

To enter one or more Contests, visit the FedEx Ultimate Fan website located at fedex.com/ultimatefan (the “Contest Site”) during the Entry Period provided above for the Contest(s) in which you are interested in entering and click on the corresponding Contest title to submit an entry. You may enter one or more of the Contests. Once an entry is accepted based on the criteria, above, Entrants must follow the steps below to participate in the Contest(s).

4. Phase 1: Written Submission (“Written Submission”)

Eligible Entrants will be required to explain in a Written Submission, in less than 1,000 characters including spaces: (a) why they believe they are the Ultimate Fan of the sport(s) category of the Contest(s) they enter; (b) what being the Ultimate Fan for that particular sport would mean to the Entrant; and, (c) what you love about any experiences you have had with FedEx the (“Written Submission”).

Entrants must upload their Written Submission(s), as directed by Sponsor, along with a selfie photograph (“Image”). The Image must show only the Entrant, who may, but is not required to, wear fan gear of the sport which is the subject of the Contest(s) entered. The Image must be in one of the following formats: .jpg, .png or .gif and must be in vertical position. The Image may not exceed 7MB.

In addition to providing the Written Submission and Image, each Entrant will be required to submit all information required by Sponsor (the “Submission Materials”), including:

Entries are subject to disqualification during any phase of each Contest(s) for failure to meet the eligibility requirements and/or failure to abide by these Official Rules. See Paragraph 9, below for more information.

All Written Submissions will be evaluated by Sponsor and given a weighted score based on the Entrant’s responses to all the information described, above, in Sponsor’s sole discretion. The twenty (20) Written Submissions with the highest scores may progress to the next Phase of the Contest(s). Entrants will be notified via email if they do or do not progress to the next Phase, Video Submission, of the Contests.

Entrants who are notified that they will not progress to the next round of the Contest(s) will no longer be able to participate in that Contest(s), but can enter another Contest(s) in the event the applicable entry period is still, or becomes, open.

5. Phase 2- Video Entry Submission, applicable only to those notified to submit a video (“Video”).

If an Entrant progresses to the Video Phase, the Entrant must upload a self-made Video, as further described below, by the date provided in the Contest Schedule(s) for the applicable Contest(s).

Videos must be no more than one (1) minute in length and submitted during the time period specified above for the applicable Contest. The Video must include the following content:

Entrants must submit the Video(s) in the format and via the link specified by Sponsor. No other video format or method of submission will be accepted (e.g., Videos cannot be emailed or require a download from a zip file, etc.). Entrant may, but is not required to, wear fan gear of the sport which is the subject of the Contest(s) they are entering.

Videos that include any lewd language, inappropriate behavior, alcohol, nudity, other people, or content which Sponsor deems inappropriate or unacceptable will not be accepted, and no alternative Video may be submitted. See Paragraph 10, below, for more information.

Entrants will receive confirmation that the Video was received for judging.

Entrants acknowledge and agree that only Videos that Sponsor deems acceptable will be eligible for continued participation in the Contest(s), and/or used/posted by Sponsor.

Only self-made Images and Videos are eligible for submission. By submitting an Image and Video, Entrant warrants that the Image and Video are self-made and the permission of no other person or entity is necessary for Entrant to submit, or Sponsor to use and post, the Image and Video.

Entrant further agrees that Sponsor may use all or part of any Written Submission, Image and Video submitted by an Entrant for any of Sponsor’s marketing, promotional and communications purposes in any manner, and that Sponsor has the right to edit any of the foregoing prior to using them, in its sole discretion. See Paragraphs 9, 10, 11 and 13, below, for more information.

Videos will be judged by Sponsor and receive a weighted score, as determined solely by Sponsor. Criteria used to evaluate Videos may include:

Entrants will receive email notification if their Videos do or do not advance to the Public Voting Phase.

Entrants who are notified that they will not progress to the next Public Voting Phase of the Contest(s) will no longer be able to participate in the Contest(s), but can enter another Contest(s) in the event the applicable entry period is or becomes open.

The Sponsor will announce a maximum of fifteen (15) Finalists for the Public Voting Stage of each Contest(s). In the event there are fewer than fifteen (15) finalists, the number of finalists to be posted for public voting is at the sole discretion of FedEx.

Finalist Videos will be posted in the Contest Gallery on the applicable Contest page within fedex.com/ultimatefan along with all or a portion of the Entrant’s Written Submission, as determined by Sponsor, for public voting.

6. PUBLIC VOTING PERIOD:

All persons located in the U.S. who have access to the internet will be eligible to vote for a Video in the Contest Gallery. Limit: One (1) vote per person per 24-hour period (12:00:01 am – 11:59:59 pm) during the Public Voting Period. Votes received from a person using the same IP address or who attempts to vote more than once for a Video during the same website session will be void and will not be counted. In the event of a tie in the number of votes received at the end of the Public Voting Phase, the Video first receiving the quantity of votes that created the tie will be selected as the winner of the Public Voting Phase.

Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means. Fraudulent or inappropriate “means” includes, but is not limited to: (a) buying or knowingly receiving purchased votes in any manner from anyone, (b) offering to anyone prizes or other inducements for votes, (c) use of any automated, robotic, repetitive, programmed, or similar registration or voting method, (d) any questionable activity, as determined by Sponsor that increases votes for a Video, including without limitation any attempts to artificially increase vote totals, or trade votes. Sponsor reserves the right, but is not required, to disqualify any Entrant who is, in Sponsor’s sole discretion, suspected of violating these terms or otherwise tampering with the voting process.

7. WINNERS:

The winner of the Public Voting Period along with the Written Submission and Video Submission scores of Entrants will be used to determine the potential winner of each Contest.

Potential Contest winners will be notified by email. Potential winners may not communicate their status or any other comments about the Contest(s) at any time without FedEx’s prior written permission. In such an event, potential contest winners may be disqualified from receiving a prize.

Once the potential winners have been identified after the Public Voting Phase, each potential winner will be required to consent to the background and reputational check. If the background and reputational check is acceptable, each potential winner must execute and return via email or prepaid FedEx shipment, an executed affidavit of eligibility, liability and publicity release, and assignment of rights (“Affidavit Package”) within seven (7) days of attempted notification by Sponsor, or the prize(s) may be forfeited and an alternate winner will be selected. See Paragraphs 9, 10 and 11, below, for more information Should the potential winner(s) not pass the background and reputational check as determined by FedEx, the potential winner(s) will be notified and the Entrant with the next highest score will be notified they are the potential winner.

By entering the Contest(s) winners acknowledge and consent that they may be mentioned/featured in Sponsor social channels, press releases, and other Sponsor selected marketing and promotional materials. Winners may not publicly communicate anything about their status as Contest Entrants, participants or winners at any time without prior written approval from Sponsor.

Winners further acknowledge and agree that they may be required to share on Entrant’s social media accounts any Sponsor selected and provided content.

All prizes for each contest include travel expenses paid by Sponsor, all as determined and arranged by Sponsor, including necessary ground transportation from arrival airport to hotel, and return, and to attend an event awarded as a prize, airline tickets, hotel, and a per diem for food and beverage expenses, as predetermined by Sponsor. All other costs and expenses are the responsibility of the winners. See Paragraph 10, below, for further information.

9. Notification:

The potential winners will be notified via email. If a potential winner does not send a return email to Sponsor within 48 hours of receiving Sponsor’s notification email acknowledging a desire to be declared a winner and receive the applicable prize, an alternate potential winner will be selected and notified using the same process described.

Once a potential winner responds as described above, and their contact information has been confirmed, the potential winner will then be required to execute and return, within seven (7) days of receipt, via email or prepaid FedEx shipment, the Affidavit Package, or the prize may be forfeited and an alternate winner selected. Winner must travel on the dates specified by Sponsor, which are subject to change or prize will be forfeited. If winner is unable to travel on dates specified, prize will be forfeited and an alternate winner selected, time permitting. Sponsor will determine ground transportation, airline and flight itinerary in its sole discretion. Airline carrier's regulations and conditions apply. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. Trip may not be combined with any other travel or offer and travel may not qualify for frequent flyer miles. In the event the winner lives within one-hundred eighty (180) miles of the location of an event awarded as a prize (in Sponsor's sole discretion), round-trip ground transportation may be provided in lieu of air transportation and no additional compensation will be provided. The travel companion must be 18 years of age or older as of the date of departure and must travel on the same itinerary and at the same time as the winner. Travel companion must execute a liability/publicity release prior to issuance of travel and prize documents. The winner and travel companion must possess valid government-issued photo I.D. and passport (if needed) in order to travel. Travel restrictions, conditions and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value of any prize. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, insurance, telephone charges, room service and laundry services, personal expenses, gratuities, entertainment, transfers, incidental charges, or any other items not specifically described in these Official Rules, any transportation not mentioned within such prize descriptions and all expenses for any of the foregoing are the sole responsibility of the winner(s). In the event that an event is cancelled or postponed due to circumstances beyond Sponsor’s control, that portion of the prize will not be awarded and no additional compensation will be provided. Failure to follow prize awards process, or return of any prize or prize notification as undeliverable will result in disqualification and alternate selection in Sponsor’s sole discretion.

10. Release:

By receipt of a prize, winners and their travel companion release, indemnify and hold harmless Sponsor, NASCAR, Joe Gibbs Racing, UEFA, PGA TOUR Inc., the NBA, the Memphis Grizzlies, and the NFL, and each of their parent and affiliate companies and their respective suppliers, distributors, advertising/promotion agencies, and each of their respective officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claims or causes of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest(s) and receipt or use or misuse of the prize (“Claims”).

11. Publicity and Intellectual Property Rights:

Entrants’ consent to Sponsor’s use of each Entrants’ name, likeness, photograph, voice, opinions, entry information, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. By entering this Contest, Entrant grants to Sponsor, its parent and affiliated companies an exclusive, assignable, royalty-free, perpetual and irrevocable right and license to edit and use all such items, information and materials submitted by Entrant in connection with the Contest, in whole or in part, for any purpose and in any manner or media now known or hereafter devised, throughout the world and to license others to do so, without notice and without compensation, royalty, accounting, liability or obligation of any kind to any Entrant.

12. General Conditions:

Sponsor reserves the right to cancel, suspend and/or modify the Contest(s), or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest(s), as determined by Sponsor in its sole discretion. If the Contest(s), or any part of it, is discontinued/cancelled for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest(s) or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest(s) may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right, in its sole discretion, to disqualify any Entrant at any time that it finds to be tampering with the entry process, voting process or the Contest; to be acting in violation of these Official Rules; or to be acting in an inappropriate or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Entries submitted (“Submitted Entries”) must be consistent with Sponsor’s mission, strategy, and values and Sponsor reserves the right, in its sole discretion, to reject and/or disqualify any entries at any time that Sponsor deems to be hateful, slanderous, libelous, violent, obscene, defamatory, discriminatory (based on age, race, gender, religion, natural origin, physical disability, sexual orientation or political affiliation), profane, offensive, lewd, sexually explicit, pornographic, false, misleading, deceptive, self-mutilating (e.g. relating to murder, the sales of weapons, cruelty, abuse, etc.), illegal (computer hacking, underage drinking, etc.), threatening, harassing, or otherwise inconsistent with its editorial standards, audience expectations, or reputational interests or that contain images, words or symbols widely considered offensive to individuals of a certain race, gender, ethnicity, religion, sexual orientation or socioeconomic group, or that Sponsor believes may violate any applicable law or regulation or the rights of any third party or may subject the Contest, Sponsor, or Sponsor's advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule. For purposes of this paragraph, Submitted Entries include content on the Entrant’s website and social media sites. Should Sponsor determine, in its sole discretion, that any announced winner has violated any of the prohibitions contained in these Official Rules or should be disqualified for any other reason, Sponsor shall have no obligation to award a prize to such Entrant. Event and venue rules and restrictions apply and winners must comply will all such rules and restrictions to attend.

13. Limitations of Liability:

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest(s); (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest(s); (4) technical or human error which may occur in the administration of the Contest(s) or the processing of entries; or (5) late, lost, undeliverable, damaged or stolen mail, entries or email. If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is to submit another entry in the Contest(s), if it is possible.

14. Disputes and Claims:

Entrant agrees that: (a) he/she releases and will defend, indemnify and hold harmless the Released Parties from and all any and all Claims arising out of or connected with this Contest(s), or the prizes awarded; (b) all Claims shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in western Tennessee, Shelby County; (c) Entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Tennessee for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (d) any and all Claims, judgments, and awards shall be limited to actual damages of no more than $100, including costs associated with entering this Contest(s), but in no event attorneys' fees; and (e) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants or the Released Parties in connection with this Contest(s) shall be governed by, and construed in accordance with, the laws of the State of Tennessee, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Tennessee, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Tennessee.

15. Data Protection/Privacy Policy:

Information collected by Sponsor in connection with this Contest(s) may be used by Sponsor and shared with third parties in accordance with the online Privacy Policy posted on https://www.fedex.com/us/security/privacy-policy-us.html and applicable data protection laws. The Entrant agrees to the collection, processing and storage of the Entrant’s personal data by Sponsor for purposes of the Contest(s). By selecting the option to receive promotional email from Sponsor, Entrant agrees to receive future emails from any Sponsor company. FedEx Corporate Services, Inc. is the data controller and the data recipient.
